Abstract: The research analyzes the judicial deference granted by the Brazilian Supreme Federal Court (STF) to the decisions of federal regulatory agencies in the exercise of their technical-sectoral regulatory powers. The objective is to describe the reality of the case law by developing quantitative and qualitative empirical research based on the analysis of published appellate decisions (acórdãos) whose primary issue is the judicial review of the acts, norms, and decisions of those entities. The central question is: is there a predisposition toward deference in the case law? In this context, based on the conceptual parameters developed in the first chapter, judicial deference was understood as a power-duty of self-restraint qualified by the judiciary's institutional respect for other entities, in harmony with the democratic parameters of the Brazilian legal system. The second chapter focused on the study of regulatory agencies, specifically regarding the judicial review of their activities. The final part of the dissertation was dedicated to the implementation of the empirical research. Initially, a raw database was compiled by selecting cases in which the agencies were parties to the legal proceedings. Subsequently, decisions containing discursive elements indicating the presence or absence of deference were added. The application of methodological filters (cases filed between October 5, 2010, and October 5, 2024, in which there was a judgment on the merits of the main issue via a published decision) resulted in a refined database. The selected decisions were classified as deferential, interfering, or unrelated to technical-sectoral regulation. Three situations were considered as deference: the maintenance of the agencies' actions, the preservation of the agencies' technical judgment, and the presence of explicit deferential discourse. Opposite situations were defined as hypotheses of interference. Conversely, when the litigation was decided while disregarding the regulatory agency or its regulatory performance, it was classified as unrelated to technical-sectoral regulation. The results revealed a predominance of deferential decisions. It was further observed that the rulings were preceded by judicial oversight and accompanied by justifications for intervening or not in the choices of the regulatory agent. Thus, the data evidenced that a deferential judicial decision by the STF does not imply the abdication of jurisdictional control, nor does it result from an automatic or mandatory agreement with the regulation promoted by the agencies. It is the result of a weighted judgment of selfrestraint, which preserves the performance of those entities without removing the oversight of the legality of their acts, norms, and decisions. It is, in fact, a form of balance between judicial review and the preservation of the autonomy and authority of regulatory agencies.
