| Abstract: | The present master's dissertation aims to verify how the uranium mining activity in Brazil is placed, in general terms and specifically in the environmental issue. In this regard, the double risk of uranium is presented, being toxic and radioactive. While toxicity is a particular chemical characteristic of the uranium element itself, radiation comes mostly from radon gas, which is generated from the natural decay of uranium, a process in which the chemical element emits particles or radiation and transmutes to become more stable. Although the studies of the risks of damage related to uranium mine workers are scientifically proven, scientific uncertainties remain about the extent of the damage to regions close to this type of activity. Despite being an element considered to be carcinogenic, and representing more than half of the natural radiation that humans in general receive during their lives, radon in the open environment, especially in places rich in natural uranium, or adjacent to uranium mining operations, still does not have a regulation that guarantees adequate social and environmental protection, especially when considering possible scientific uncertainties inherent to its radiation and contamination risks. In this sense, when we observe an international and national order with regulatory gaps for the control of uranium in natura, especially in situations of open-pit extraction, and with regard to its natural decay, which may generate greater exposure to radon gas, in which there is a state of uncertainty about the extent of damage beyond the mining, the Precautionary Principle in Environmental Law is presented as an adequate instrument to fill in the gaps in the legal system and as a means of minimally ensuring responses to the risks for populations residing near uranium mines. |
