Resumen : Esta tese analisa como o valor econômico do trabalho doméstico perturba a ideia de Estado Democrático de Direito, consagrado no Brasil com a Constituição Federal de 1988, a partir de um estudo de caso sobre o processo de constitucionalização dos direitos da categoria profissional de trabalhadoras empregadas domésticas. A tese interpela a Teoria da Constituição desde a relação entre cidadania e dívida. A dívida impagável é uma ferramenta da poética feminista negra para contrapor a logica sociohistorica da exclusão e despensar o mundo e o sujeito moderno desde a carne ferida desgenerificada. A carne informa as estratégias de controle do Estado sobre corpos femininos e famílias negras, entendidos como degenerados e patológicos na construção dos direitos sociais. A carne, referente da coisa indeterminada, que foge à captura das categorias jurídicas, é o que emerge no processo da investigação e na produção desta narrativa sobre os belos experimentos de trabalhadoras domésticas brasileiras em suas lutas por direitos. Propondo um diálogo teóricometodológico entre diferentes tradições dos feminismos negros desde o campo do Direito, e recorrendo à tensão entre politica da realização e politica da transfiguração, ofereço essa escrevivência de pesquisa, ou curso indisciplinar de Direito, Relações Raciais e Gênero.
Abstract: This dissertation examines how the economic value of domestic labor unsettles the idea of democratic constitutional state through an analysis of the constitutionalization of the rights of domestic workers as an occupational category. The 1988 Federal Constitution was the first Brazilian constitution to recognize domestic workers as such, elevating their rights to constitutional status. The question emerged from previous research. In the records of the National Constituent Assembly (Assembleia Nacional Constituinte – ANC), I found that the main reason for denying domestic workers equal rights was the claim that their labor lacked economic value. As a result, the final text incorporated domestic workers into the new constitutional order separately from other workers, granting them only nine of the thirty-four fundamental labour rights. In parliamentary debates, prevailed versions of the national text associated with the myth of racial democracy, and historical-materialist accounts centred on free white labour under the legal form of contract. Both locate slavery in the past within the temporal unfolding trajectory of Spirit, as incompatible with citizenship, while presupposing the expropriation of Black women's labour. The demand for recognition advanced by domestic workers' associations prompted an interpellation of constitutional theory through the relationship between citizenship and debt, drawing attention to the tension between dignity (the quality of the human) and fungibility (the quality of the thing) in the production of the modern subject. The distinction between Self and Thing lies in the legal form through which labour time is appropriated, whether by contract or by title of property. This tension unsettles the inclusion/exclusion dichotomy from the afterlife of slave property in the regulation of the Black sexual body, as incorporated into the 1988 Social Order of Labour. It suggests the presence of the spatial-biological-scientific within contemporary sociological discourses of difference. I refer to accounts of the Brazilian people as "pathological" for democracy, particularly onto Black women and their families. The co-originality of public and private autonomy, a cornerstone of the proceduralist paradigm of the democratic constitutional state, is revisited through the legacy of the women's movements during Brazil's democratic transition, of which domestic workers' associations formed part. Drawing on the distinction between a politics of fulfilment and a politics of transfiguration, in dialogue with different traditions of Black feminist thought, I seek to elaborate beyond participation in the public sphere by attending to the opaque, the erratic, fragmentary, sensory, unspeakable. The use of empirical sources and writing across ideology of style in legal writing are central to this dissertation. In this sense, the thesis offers an escrevivência of research, or an indisciplinary course on Law, Race Relations and Gender.
