Abstract:	The present study has as nuclear subject the constitutional guarantees of the profession of the lawyer and the effect of its civil liability for pecuniary and moral damages with focus in the General and Professional Ethics. The objective research, still, to demonstrate that legal education intervenes on deficient or competent behaviors, magnifying or reducing the incidence of harmfill acts in the professional exercise, having to be stimulated, therefore the evaluation of the conditions of the legal courses in all Brazilian territory. As form to demonstrate the importance ofthe lawyer in the Brazilian partner-legal life, the legislator-constituent determined its indispensability to the management ofjustice and its professional inviolability in the limits of the law, as form also, of legal security. It will be seen, finally, that, to improve its professional performance, is necessary that the lawyer has conscience of the its social importance ofthe distribution ofjustice and that the lack technique and absence of ethical values are causes of the crisis of the advocacy and the judiciary power.
