Abstract:	In the face of serious problems arising from the production of risks by modern societies, certain preventive controls are required to protect the environment. Environmental licensing is an important control tool that allows the public authority to set limits and restrictions on economic activities and, as a result, prevents or reduces pollution and encourages sustainable development. One critically important point is that the authority to pass legislation to protect the environment is similar at the federal, state, and local levels, creating conflict and incompatibility among different states and different governmental bodies. From the analysis of the environmental licensing of agricultural activities in the states of Pernambuco and Bahia, specifically in the municipalities of Petrolina and Juazeiro, the research confirmed that both states have broad freedom to legislate on environmental issues, which creates incongruities between the state structures of the environment, such as the parameters used for the exemption from environmental licensing regulations. Since environmental problems do not stop at geographical lines, separate municipalities or states of the federation, must collaborate to control and protect the environment with a uniform approach, by enacting laws that apply throughout Brazilian territory, while taking into consideration the environmental characteristics of the diverse regions.
