Experimentação animal no Brasil : panorama da lei federal nº 11.794/2008 (Lei Arouca)

Abstract

Entre setenta e cinco e cem milhões de animais vertebrados são utilizados em pesquisas por ano. A experimentação animal gerou um debate ético global que persiste há várias décadas, englobando posicionamentos teóricos e políticos que vão desde a redução do sofrimento infligido até a total e irrestrita proibição do uso de animais. Dessa forma, os países sentiram a necessidade de elaborarem leis que regulamentassem a matéria, entretanto, até 2008 não havia regulamentação da mesma no Brasil. A metodologia utilizada para realização deste trabalho baseou-se na pesquisa bibliográfica, notadamente na análise, avaliação e integração de informações disponíveis sobre a regulamentação da utilização de animais no Brasil, na tentativa de entender a atual situação brasileira, fazendo um paralelo com a legislação da União Europeia (UE) e tentando verificar quais aportes éticos estavam presentes no texto legal. A Lei nº 11.794/2008 é a primeira legislação brasileira a especificamente regulamentar a experimentação animal, determinando a adoção de práticas de pesquisa que prezem pelo bem-estar animal, pela redução do sofrimento e do número de espécimes utilizados, incorporando o aporte dos “3Rs” - replacement (substituição), reduction (redução) e refinement (refinamento) – e reconhecendo que os animais sentem dor e necessitam de cuidados especiais, dialogando, com o discurso ético de Peter Singer. A legislação da UE data de 1986 e com o passar do tempo tem apenas realizado a adaptação e evolução de um sistema já vigente, inclusive institucional, enquanto que o Brasil passa pelo momento inicial de implementar um novo sistema sem que houvesse um alicerce anteriormente existente, por isso posiciona-se um pouco mais tímido quanto às metas e regulamentações. A Lei ainda está em fase de implementação e depende da ação do governo sobre os muitos e complexos aspectos relacionados aos recursos humanos, treinamento e educação sobre cuidados com os animais, centros de pesquisa animal, técnicas de substituição da experimentação animal, instalação do sistema e comunicação dos dados estatísticos que serão produzidos, mas a legislação configura-se como um avanço ante o vácuo legislativo anteriormente existente. _______________________________________________________________________________ ABSTRACT

Between seventy-five and one hundred million vertebrate animals are used in research each year. Animal experimentation has generated a global ethical debate that has persisted for several decades, encompassing theoretical and political positions ranging from reducing the suffering inflicted by the full and unconditional ban on the use of animals. Thus, countries felt the need to draw up laws regulating the matter, however, until 2008 there was no regulation of the same in Brazil. The methodology for this study was based on the literature, notably in the analysis, evaluation and integration of available information on regulation of the use of animals in Brazil, in an attempt to understand the current situation in Brazil, making a parallel with the laws of European Union (EU) and trying to see which contributions were present on the ethical legal text. Law nº 11.794/2008 is the first brazilian law specifically to regulate animal experimentation, determining the adoption of practical research that values animal welfare by reducing the suffering and the number of specimens used, incorporating the contribution of the "3Rs" - replacement, reduction and refinement - and recognizing that animals feel pain and require special care, talking with the ethical discourse of Peter Singer. EU legislation dating from 1986 and over time it has only done the adaptation and evolution of an already existing system, including institutional, while Brazil is in the initial stage of implementing a new system without an existing foundation previously therefore positions itself a little more timid on targets and regulations. The Law is still in implementation phase and depends on government action on the many complex aspects of human resources, training and education on animal care, animal research centers, technical replacement of animal testing, system installation and communication of statistical data that will be produced, but the legislation appears as an advance against the previously existing legislative vacuum.
