| Abstract: | The adjacent territory of Ubatuba-Paraty is an important area for biodiversity conservation in the Atlantic Forest, which covers a stretch of protected areas Mosaic Bocaina with significant presence of traditional populations. However, unplanned urbanization, land speculation and the installation of infrastructure are exerting increasing pressure on protected areas. Different instruments of regional planning were established with the objective of planning the uses of the land and conserve the coastal ecosystems. It happens that every instrument has scales and different management objectives, thus hindering their integrated application by different agencies. Given this context, this thesis aims to analyze the conflicts and complementarities between the instruments of regional planning boundary of Ubatuba-Paraty. Another objective is to analyze how such instruments affect the territorial rights of communities caiçaras, quilombolas and indigenous. The results of the study reveal that the instruments of territorial theoretically keep sync with each other and are apparently complementary. But in many cases, these instruments are contradictory and reveal territorial disputes due to real estate interests on protected natural areas or the presence of traditional populations. They also demonstrate the dilemmas of reconciling interests in the preservation and use of biodiversity in areas occupied by caiçaras, quilombolas and indigenous. The instruments analyzed generate doubts and different interpretations about what rules apply. Moreover, they are susceptible to political interference, are hampered by limited institutional capacity for management and reflect the asymmetry of power between social groups. The work presents parameters for the management of land conflicts identified, the application of instruments in each community and a summary of the rights of traditional populations. The findings indicate the need to adopt mechanisms for coordinated action among the organs of territorial management. Point Bocaina Mosaic, which brings together agencies from all tiers of government and civil society entities, as the most appropriate forum to work with the potential conflict management, integrated management of land and the realization of joint land rights of traditional populations. |
