Abstract: This research analyzes, through the mapping and systematization of the legislative proposals in progress in the Chamber of Deputies and in the Federal Senate, how the debate on terrorism continues to reverberate in the National Congress after the approval of the Antiterrorism Law, nº 13.260, of march 16, 2016, which completed five years in 2021. It is proposed to investigate and answer the following research questions: a) do social movements, protests and demonstrations occupy a prominent place in the public- legislative debate on terrorism in Brazil? b) the legislative proposals in progress in the Chamber os Deputies and in the Federal that aim to propose changes in Law 13.260/2016 indicate a scenario of increase in the exercise of political manifestations and protest? And, finally, c) is the approval of the Anti-Terrorism Law a empirical phenomenon to be observed by the political science literature in the analyzes about desdemocratization and post-democracy in Brazil? Because of the approval of the Antiterrorism Law in Brazil triggered the alert from national and international entities, in addition to social movements, who denounced the risks and threats of legislation on the exercise of protest, demonstrations and civil society organizations. Taking the alert as a starting point, the research hypothesis that guides the development of the work is that the legislative proposals in process in the National Congress that aim to modify Law nº 13.260/2016, reverberating the legislation in the National Congress, indicate a window of opportunity for the criminalization of protest and social movements in Brazil. The results indicate that in the Bolsonaro government not only did the number of proposals involving terrorism and demonstrations increase, but the political rhetoric of framing social movements as a “terrorist” entered the agenda of the federal government, reviving opportunities for recrudescence and affirming the constitution of “label” around terrorism. Actors in a position of power have acted and continue to act in Parliament with expressive capacity for articulation around the approval of proposals that present risks of retrogression and damage to the democratic space due to the definitions of terrorism and counterterrorism that it presents, as well as the possibility of criminalizing the performance of leaders, movements and civil society organizations.
