Abstract: This research sought to answer when, how and why the Supreme Court of the United States applies – or cease to apply – its domestic law, through the extraterritorial jurisdiction, over countries of Latin America to expand its priorities. The Latin-American delimitation arises from the need to explore the expansionist practices of the United States through jurisdiction in the region. This delimitation is justified by the scarcity of research on the proposed theme in the history of international law and, foremost, in the Third World Approaches to International Law (TWAIL). The objective is, therefore, to analyze decisions of the Supreme Court of the United States in which Latin-American countries appear as parties, in order to identify whether the North American country intended to cast its interests in the region through jurisdictional means. With the purpose of delimitating the corpus of analysis, all decisions issued by the aforementioned court were mapped, covering the period from 1791 to 2021. This research identified a total of eleven decisions that fit into the proposed scope, through which the US jurisdiction examined cases involving the sovereignty of Latin America. To this end, this objective unfolds in some specific intentions, namely: (a) to identify the historiographical contributions, primarily, of the postcolonial critiques and the TWAIL for the studies of extraterritoriality in international law; (b) to point out the theoretical paradigms on extraterritoriality and sovereign immunity in the United States; (c) to investigate other forms of US legal expansionism, namely through executive-economic means; (d) to interpret the eleven decisions of the Supreme Court mentioned above to verify possible alterations in the North American extraterritorial jurisprudence. To fulfill these purposes, Arnulf Lora, Turan Kayaoğlu, Tonya Putnam, Kal Raustiala e Xiaodong Yang provide the theoretical-conceptual guidelines for this research. Furthermore, it is intended to use the lenses of postcolonial and third-world approaches in order to materialize the desired investigation. As a result of the analysis, by combining the moments in which there were changes in the country’s jurisprudence in relation to extraterritoriality and immunity from jurisdiction, three distinct periods were identified in the case-law examined. The first was established between 1903 and 1943, in which the principle of strict territoriality and the absolute state immunity prevailed. The second period begins in 1945 and reaches the year 1976. The effects theory replaced the strict territoriality, and the absolute immunity, in thesis, remained in force. O third moment comprises the years between 1989 and 2017. The effect theory advanced, while the restricted sovereign immunity was definitively established in the United States. In search of satisfactory answers to the proposed questions, the analysis made in this research brought more questions than solutions.
