Abstract: The international maritime labor regimen is characterized by international conventionality as well as autonomous, non-state rule, acknowledging individual and collective agreements, even internationally, therefore it is necessary to define clear criteria for international maritime labor law enforcement, be it heteronomous or autonomous, intern or international. Thus, the thesis problem could be synthetized as follows: to which extent do international maritime labor laws have extraterritorial efficacy in Brazil? As a relevant thesis problem, it may also be inquired: to which degree does the extraterritoriality of international maritime labor law strengthen maritime labor relations? As for the methodology to approach the thesis problem put forth, the research conducted will be theoretical, doctrinal, jurisprudential, and it will regard comparative law and case studies. It is worth noting that a case of great relevance to this thesis was meticulously analyzed in which a normative conflict was involved and wherein workersin slave labor-like conditions in cruise ships were rescued, and other 172 (one hundred seventy-two) Tribunal Superior do Trabalho (Brazilian Superior Labor Court) judgements of interest to this research involving enforceable law, maritime labor and international law were studied; the use of comparative law, in its turn, aims to examine whether there are clear rules, in diverse legal orders, regarding enforceable law, jurisdiction and circulation of agreements and collective conventionsin maritime labor law. Absence of clear criteria for the enforcement of international maritime labor legislation and difficulty in acknowledging the enforcing of autonomous extraterritorial norms were shown. As a result, the conclusion reached is that the applicable ruling to the international maritime legal hirings will be the heteronomous one along with the autonomous one, respecting the freedom of association and protection of the right to organize convention, proximity principles and the most beneficial norm for the labor relation in analysis, be it national or extraterritorial. Regarding jurisdiction, despite the indispensability of analysing the intern rules of each country according to the factual case, when it comes to the Brazilian jurisdiction, it can be called into action by foreign or national worker, when there is proximity, if the hiring took place or was executed in Brazil, or if the employer has headquarters or representation in Brazil, arbitration and forum election clauses not being applicable, it is possible do adopt an autonomous transnational or extraterritorial effective negotiation or norm, in accordance with the dictates of freedom of association and protection of the right to organize convention. With the acknowledgement of normative extraterritoriality in maritime labor law, the minimum baseline for human workers’ rights will be incremented, inhibiting social setbacks. In accordance with the 2030 Agenda for Sustainable Development, which has been influencing legal orders around the world, but which still hasn’t gained major relevance in the internal national maritime labor legal order, decent work must be universally achieved, with the acknowledgement of favorable norms for maritime workers, even if they are extraterritorial and autonomous.
