Abstract:	The Constitution of 1998 created a universal, free and integral public health system, placing the right to health at the category of fundamental social rights. Over the years, however, the perception that the constitutional promise has not been fulfilled has become widespread among the population. The serious, persistent and undeniable shortcomings of the Unified Health System (SUS), together with the role played by judicial bodies, transferred part of the locus of implementation of the right to health of the executive and legislative branches to the judiciary, in what is conventionally called of health judicialization. The thousands of demands determining the delivery of medicines, hospitalizations, etc. have drawn the attention of researchers who have come to question the legitimacy of the judiciary and the impact on the sustainability of health policies. In large part, legal research on the subject has also been devoted to delimiting the scope of juridical and normative effectiveness of the right to health, being known the academic production on subjects as existential minimum and reserve of the possibilities. This work, however, adopts a different approach on the phenomenon of the judicialization of health, being essentially concerned with its redistributive consequences. That is, with the possibility of operating an egalitarian and generalizing realization of the right to health by the justice system. The research question, therefore, is whether the judicial model constructed by the courts from the 1990s promotes equity or accentuates perceived inequities in the field of access to health care. In other words, the objective is to investigate whether, at the intersection between the health system and the justice system, where the model of wide and unrestricted judicialization prevailed, which considers possible to deliver everything to all, equity is promoted or perceived inequities in the field of access to health in Brazil are accentuated. As a working hypothesis, it is stated that by making unconscious allocative choices, ignoring the problem of scarce resources, the Judiciary favors social groups that have better access to justice, which are, as a rule, the same groups that experience better access to health. As a consequence, there is an accentuation of regressivity in health spending, especially drug spending. There is, therefore, an overlap of perceived inequities in the health field, which are determined by socioeconomic factors such as income, place of residence, region of the country, schooling, etc.
