Abstract:	Guided by the theories of decoloniality and performativity and with the purpose of introducing corporeity into legal theory, this thesis raises the question of the possibilities of an expansive theory of the human in law. To tackle this task, first, it re-reads theses ground theories to say that it is in the intervals between force and effect, between pronouncement and application, between the self and the other that one finds the possibility of producing knowledge outside a coloniality that excludes and violent subjects. Then, it reads the body as place and source of knowledge that, in the Brazilian context, is a place and source of articulation of sex, gender and race that come to function, in coloniality, as ways of opposing human and nonhuman, what I called white and cis-heteroconforming matrix or ideal. Reading the genre as performativity and race as the product and central production of coloniality, the thesis brings the body to reveal the inhumanities produced by human discourse and theory in Law. With the same theoretical matrices, Law is read as a performative speech act, a statement that does something at the moment it is uttered and which, as such, is part of a historical chain of meanings that organizes thinking in a binary way and which is established and repeated simultaneously as violence: coloniality. This reading allows both to recognize Law as violence, and in it to find possibilities of using its language to construct subversive senses. Thus, the thesis reaches the need to evaluate the ways in which the human enters the law and uses two terms of the constitutional text that perform this task: people and human dignity. Without aiming to solve the universalism / individualism opposition contained in these categories, it argues the frontier as a place of expansion: a people that performs pluriversalitiess and the human person in their multiplicities. This expansive theory requires recognizing that the human being is in the process of and places the limit of the senses produced by the tension between the two categories in the body, which will require the commitment and the responsibility for diminishing the differential distribution of humanity produced in the white cis-heteroconforming matrix and the recognition that the subject who gives himself the "law" must be able to make himself a people and a human person.
