Abstract:	This thesis seeks to investigate the mechanisms of power that place equality as the antithesis of difference, and to recognize that the opposite of equality is not difference but inequality, which affirms equal rights. The thesis assumes that the right to being different is the true meaning of equality. Therefore, it reflects on the process of women’s learning of oneself throughout the feminist struggle in which, historically, women have engaged in affirming their rights, which is seen now as an amenable approach recurrently more complex, critical and plural in relation to the construction of identity through the recognition of differences. In this sense, it is more than pertinent to consider how a critical perspective contributed to forming the current bases of discussion regarding women’s identity and to transforming possible misconceptions in evolutionary achievements or cognitive acquisitions, as well as to consider a political and critical theory that promotes the engagement and strengthening of women. It questions the supposed institutional achievements of women in this struggle for rights in legal paradigms (liberal, social and democratic) to understand the dichotomy equality/difference. Consequently, it raises discussion on how the recognition of the right to equality as difference opens a way to thinking about equality geared toward minority rights and to the type of recognition it deserves, that is, of one’s difference, way of being, or identity. The theme investigated leads to the analysis of interpretive proposals and communicative rationalities that argue, from a legal-discursive perspective, connected to the context of post-modernity and the networked society, the institutional mechanisms of the advancement of the equality of rights for women, as in the cases tried by the Brazilian Supreme Court, and what we learn rationally and cognitively from their theoretical-methodological constructs regarding the identity of women in relation to equality/difference.
