| Abstract: | Sabe-se que os principais alvos do encarceramento provisório são os praticantes de crimes patrimoniais. Mas há diferenças entre eles? Esta pesquisa buscou conhecer o perfil dos presos sem condenação, acusados de furto e estelionato. A escolha dos crimes ampara-se no fato de que, embora o processo penal brasileiro impute penas semelhantes a ambos os tipos penais, o sistema de justiça tem acolhido de maneiras distintas um e outro casos. A hipótese desta pesquisa é a de que o agente da ação, e não a ação em si, tem sido objeto de punição. |
| Abstract: | It is known that the main targets of provisional incarceration are the perpetrators of property crimes. But is there a difference between them? The Agent Action or the Action Agent? Arrested Without Condemnation on the Periphery of Alagoas sought to know the social characteristic of prisoners without condemnation, accused of theft and fraud. The choice of crimes is based on the fact that, although the Brazilian criminal proceedings impose similar punishment to both types of criminal offences, the justice system has received in different ways their accused. The hypothesis of the research is that the agent of the action and not the action in has been the object of punishment. |
