| dc.description.abstract | A pesquisa investiga que padrões caracterizam a atuação do Senado Federal na apreciação dos indicados ao Supremo Tribunal Federal (STF) no período de 1989 a 2023. O campo brasileiro sobre o tema é incipiente, marcado por dispersão terminológica, predominância teórica e ausência de base empírica longitudinal. O primeiro capítulo mapeia e delimita essa literatura, identificando como lacuna central a ausência de cobertura longitudinal completa e de desenho metodológico que permita comparação sistemática do comportamento do Senado ao longo do tempo. O segundo capítulo apresenta o desenho metodológico, estruturado em quatro dimensões de análise: votação, tramitação, partidos políticos e sabatinas, cobrindo as 28 indicações realizadas desde a promulgação da Constituição de 1988. O objetivo é produzir inferências descritivas a partir de banco de dados original, organizado e disponibilizado integralmente para verificação e replicação. Aplicaram-se medidas de estatística descritiva e cinco testes não paramétricos. Os dados das sabatinas foram coletados das notas taquigráficas, com categorização temática assistida por modelo de linguagem (LLM) e validação integral pela pesquisadora. O terceiro capítulo apresenta os resultados das quatro dimensões e suas associações. O último capítulo organiza os resultados em três fases do comportamento do Senado nas sabatinas ao STF entre 1989 e 2023 e os dialoga com a literatura. Além disso, a polarização política afetiva é mobilizada como chave interpretativa para a mudança de comportamento do Senado, com convergência temporal entre as fases da polarização no Brasil e as transformações observadas nas sabatinas. Ao final, é explicado que caráter protocolar da sabatina não é uma propriedade permanente do processo, mas uma condição determinada pela força da coalizão presidencial. O estudo conclui que as sabatinas deixaram de ser protocolares e a pesquisa contribui para a consolidação de uma agenda empírica sobre o tema no Brasil. | pt_BR |

| dc.description.abstract1 | This study sets out to determine whether there are patterns in the Senate's conduct
during the process of selecting Justices of the Federal Supreme Court (STF) and, if so,
what those patterns are. To this end, the study systematically analyzes, from a
longitudinal perspective, the nominations that occurred between 1988 and 2026,
thereby covering the period following the current Constitution. The first chapter
presents the state of the art on the research object, demonstrating through a systematic
review that the literature on the subject has rested, in large part, on the premise that
the confirmation hearings (sabatinas) are merely ceremonial. More recent works,
however, have begun to identify changes in senators' conduct throughout the process,
though they observe isolated hearings and are therefore unable to offer a broader view
of this shift. The second chapter sets out a methodological design grounded in statistical
analysis to describe the Senate's role in the selection of Justices, focusing on four
dimensions: processing time; voting in the Committee on Constitution and Justice (CCJ)
and in the Plenary; the parties occupying key positions (President of the Republic,
President of the Senate, President of the CCJ, and rapporteur); and the hearings
themselves (duration, number of participating senators, number of questions, the
procedure followed, and the topics raised). The topics identified were categorized using
artificial intelligence under human supervision, with a detailed account of the procedure
provided for peer scrutiny. The third chapter presents the findings through charts, a
heatmap, and tables, thereby identifying trends in the Senate's collective conduct and
inflection points over the years. The fourth chapter proposes periodization based on
these findings, organized into three phases: low contestation, episodic contestation,
and structured contestation. The data must be read in tandem with the political
moments Brazil has experienced, and the thesis demonstrates that the proposed
periods coincide with the country's movement toward polarization. The thesis argues
that the claim that the hearings held between 2000 and 2011 were merely ceremonial
should be read with caution. The rejection of Jorge Messias is not the sole criterion for
asserting that the hearings are not ceremonial, since earlier nominations already
revealed a gradual erosion of senators' approval. The research concludes that a
ceremonial character is not an inherent condition of the hearings, which may or may
not take on this trait. Theoretically, interpreting presidential nomination and Senate
review as coupled stages may explain the continuous approvals observed up to 2026.
The database compiled by this research seeks to address the empirical gaps in the
literature on the subject and opens new avenues for research on the theme. | pt_BR |
