Abstract:	This study ponders on a right guaranteed in the present constitution as fundamental, which origins reaches the natural right. The purpose is to write about its evolution, intending to show the nowadays reality, proposing suggestions. General aspects about the theme were accosted, its importance, citizenship, concepts, distinction in its utlization, the guarantees and general extant limitations. As well, the attention ofthe study was directed to the politics of access to justice, to the institutions and mechanisms, people and procedere, searchind the transformation ofthe structure, making the law courts and procedures less bureaucratic. Finally, approaches about the several available instruments to the access to justice were realized, concluding in verifying altematives, showing up the Special Civil Judgeship, suggesting purposes to operate betterthis actual and important organ ofthe Judicial Power.
