| Abstract: | The thesisinvestigates the relationship between the emergence of new constitutional meanings and the continuous exchange of arguments between public sphere, Legislative Power and constitutional jurisdiction, around themes of constitutional nature. As a general objective, the search for a theoretical perspective capable of describing how they arise and what is the role ofnew constitutional meanings in this process of circulation of arguments was established. As specific objectives, the research proposed: to address the essential conceptual elements of the discursive theory of law, especially in the perspective of Jürgen Habermas, and of the democratic constitutionalism of Reva Siegel and Robert Post; to make use of such elements in the construction of a case analysis methodology, whosefocus would be the comparison between arguments conveyed in different deliberative spheres about the same constitutional issues; and, finally, to use the two theoretical frameworks and the conclusions of the empirical analysis to outline the intended theoretical model. The feasibility of these objectives required three stages of research. Thefirst consisted of presentingelements of the discursive theory of law and democratic constitutionalism. The discursive model is based on a theory of society that sees a porosity between law and the public sphere, which should be understood as a wideand diffuse network of communications, reproduced by communicative action. Democratic constitutionalism, on the other hand, demonstrates the steps of changingthe meanings of the constitution based on the action of social movements and recognizes the normalityof backlash as part of the permanent dynamics of movements and countermovements that unfold among civil society and official institutions. The common point between the two perspectivesis the mobility of constitutional meanings under a temporally extendedperspective. While the discursive conception focuses on the search for consensus based on discourse, democratic constitutionalism emphasizes dissent as the driving force behind mobilizations and counter-mobilizations that oxygenate the content of the constitution.The second stage consisted of an examination of the constitutional discussion on the expansion of the legal hypotheses of abortionin the Brazilian context.A methodology for classifying and comparing arguments was proposed and detailed, based onthe theoretical models previously exposed. Then, with the help of the Nvivo software, the compositions of the arguments conveyed in briefsand opinions in ADPF 54, ADI 5581 and ADPF 442 were compared with the content of speeches given by congressmenand of statements on Twitter.The third stage consisted of presentinga descriptive perspective of the dynamics of discursive exchange on constitutional issues, in which the public sphere provides the arguments to be mobilized in the Legislative power and constitutional jurisdiction, and later presented to the public. Such reasons are again conveyed in later deliberations, catalyzed by interested and influential actors onthepublic opinion. In this circularity, it is possible to reinterpret and critically reassess past decisions, in discourses that take place in formal and informal spheres of deliberation. New constitutional meanings emerge to enable the translation of different social perspectives in terms of legal discourse, which allows the continuation of the search for intersubjective understanding in the midst of broader dissent, within the democratic process. There remains a potential to increase the rationality of public debate around constitutional issues at each deliberative cycle, according to a discursive conception of democracy as a collective learning process. |
