| Abstract: | This thesis examines, in a contemporary context, how immigrants reach social policies in Brazil after the approval of the Law 13,445 of 2017 (New Migration Law). For that, it started from the concrete reality, that is, the reality lived by the Venezuelan immigrants in the state of Roraima. It is argued that Law 13,445 / 2017 represents a new paradigm for immigrants in Brazil, as it establishes as a principle of Brazilian immigration policy, equality between nationals and immigrants with regard to the inviolability of the right to life, freedom, equality, security and property. From this legal framework and its regulation, it was observed that the materialization of the principles that govern the immigration policy, presumes the access of immigrants to social policies. Thus, from the categories of social policy, capitalism and immigration we sought to investigate in detail the intricacies that surround this reality using primary data – conducted field research in the state of Roraima, interviews with social policy managers and immigrants - and secondary - documentary and bibliographic analysis. Thus, it was found that the neoliberal project underway in Brazil, contrary to the materialization of immigrant rights historically conquered, reinforces stigmas and stereotypes of blaming immigrants, and, through militarization of migration, tends to distance themselves from the guidelines of an emancipatory migration policy. With this, the State ends up disregarding the positive potential of migration and uses social policies as a political mechanism that drives competition between immigrants and nationals. As a result, the organizational bases for the promotion of an effectively welcoming society are not collectively constructed. So, the context of the state of Roraima is marked by disputes and confrontations that reflect different societal and class projects, in which collective subjects emerge who stand in defense of a concept of a society free from exploitation, prejudice and violence against immigrants. However, despite being resistant these subjects are against the hegemonic neoliberal project in course, consequently, the construction of a counter hegemony can only occur with the active participation of Venezuelan immigrants in articulation with the movements that share the principles of Brazilian migration policy. However, the immediate needs for survival - health, food, housing and more - while not being overcome, are the primary focus of attention of the subjects. For this reason, the importance of unveiling the reality around the access of immigrants to social policies in Brazil, as extending their reach is a vital strategy for meeting immediate needs, as a primary stage of guaranteeing and defending citizenship, even in the framework of capitalism |
