| Abstract: | This study seeks to analyze the processes through which adolescent sex offenders are held accountable. The study sought to ascertain the characteristics of these adolescents who were tried by the Federal District’s Justice System, as well as to identify how they are held accountable, and to get to know what significance is given to the correctional measures experienced by these adolescents and their families. The theoretical discussion concerning adolescence and sexuality in contemporary society as well as sexual violence during adolescence, family systems, adolescent perpetrator of sexual offence, and the liability of adolescent sex offenders are all brought forth from a systems theory standpoint. The research was conducted within a legal framework employing both quantitative and qualitative methods and has been organized into two complementary studies. The first study which is of a quantitative nature occurred through the documentary analysis of 254 lawsuits filed between the years 2013 and 2016 that were moved against male adolescents accused of committing offensive sexual acts; this involved 285 adolescents and 291 victims. An instrument was specifically designed for the process of data collection; it contains questions regarding the process, the characteristics of the adolescent and their family, of the victim, and of the act of sexual offense. All of the information that was collected was organized into a database so that subsequent descriptive statistics could be run through the IBM SPSS Statistics software. Based on the results obtained through the documentary analysis, a qualitative case study was carried out with the participation of seven adolescents undergoing social-educational measures as well as their guardians. A semi-structured interview was carried out with the adolescents and the individuals responsible for them, as well as an analysis of individual care plans, evaluation reports, and records of interdisciplinary technical monitoring as well as field notes. Qualitative data were analyzed using the Content Analysis Method. The results pointed to the diversity in adolescent perpetrators of sexual offenses and the consequential lack of a single profile. Regarding accountability, it was found that 40.3% of the adolescents involved had their lawsuits filed or extinguished and 35.3% of the adolescents were submitted to correctional measures, with noncustodial sanction measures being the favored approach. It became apparent that these adolescents remain overlooked, and this may be due to a lack of statistics concerning the sexual offenses perpetrated by them or to a lack of information regarding their social-familial and economic realities which in turn impairs the planning and execution of preventive and social-educational interventions. As for the application of socio-educational measures (MSE), it was observed that the Justice System does not have clear criteria in place regarding decisions in favor of which measure to apply. Among the measures employed, for adolescents who underwent juvenile detention, the MSE resulted in a continuation of the violence that had been experienced previously. Yet for those who were submitted to LA (Supervised Liberty) and PSC (Community Service), the MSE resulted in more concrete improvements to their social insertion although their understanding of the sexual offense committed did not evolve. The importance of not basing accountability exclusively upon punishment, but on the resocialization and specialized treatment of adolescents is therefore made evident. |
