Abstract: Judgments on access to health care in Brazil have been the subject of intense debate since the 1988 Brazilian Constitution's promulgation, focused on formal legal aspects such as: the normative effectiveness of the Constitution, the right to health extension and limits, the formal criteria and conditions for access to care, the parameters and limits of judicial intervention in health systems. What is sought in this thesis, on the one hand, is to reveal the scarcity of references to the ethical and bioethical aspects underlying such decisions. The ethical dimensions of equity in health are not addressed in all the scope and depth that bioethical reflection raises. This is what can be understood as a lack of moral reasoning, which can be evidenced by the analysis of meanings in which the principle is perceived and applied by the Federal Supreme Court. On the other hand, due to this lacuna, we seek the development of theoretical tools that allow the approximation of bioethical argumentation to legal argumentation as a way of giving greater social effectiveness to the court's ruling dealing with the task of deciding concretely the fair and equitable in health. The theoretical support of this approach is found, in the procedural aspect, in the meta-ethical principles of prescritivity and universalizability, proposed by Richard Hare, and in the division of the discourses of justification and application, proposed by Klaus Günther when analyzing the theory of argumentation in morals and Law. Both authors seek to prevent moral relativism and to enable the possibility of producing consensus in plural and complex societies. On the substantive side, theoretical support is found in the approach of Amartya Sen's capability, in Martha Nussbaum's central capabilities concept and in the concepts of health as functionings and capabilities elaborated, among others, by Sridhar Venkatapuram, Maria Clara Dias and Jennifer Prah Ruger, with the objective of identifying the possibilities, advantages and disadvantages of this theoretical instrument in the dissemination of the ethical and bioethical contents necessary for the weighting of equity in judicial decisions that allocate scarce health resources.
