Abstract:	The present study sought to conduct an analysis of the execution of the custodial sentence administered by the Convicted Protection Associations - APACs and the constitutive elements of their method, based on documentary and bibliographic research. He explained the reality of the Brazilian prison system through official statistical data, considering its unsustainability as presuppositions for the emergence and acceptance of legal entities governed by deprivation of liberty, providing a brief historical account of the evolution of criminal sanctions and their application. goal. It was also performed an analysis of the compatibility of the APAC method with the human and fundamental rights provided for in the Federal Constitution, especially regarding religious freedom, belief and sexual orientation. Voluntarity is verified as a subsistence requirement of the method and the reason why it has risen in Brazil and in other countries, winning the support of the Federated Entities. It is concluded by the relation of complementarity of APACs and not of substitutivity with the conventional prison system. Finally, we question which model of public policy, management and governmentality has been exercised by the State through these Associations, as well as its position in the human rights scenario from the perspective of its critical theory.
