| Abstract: | In a search to demonstrate the fragility of the conclusions intended historical ones and which also claim that, however the Brazilian constitutional theory would have been born with the Republican Constitution of 1891, the Supreme Federal Court (STF) wouldn’t have reached immediately all of its potential, for a supposed cognitive delay of the ministers and lawyers at the time, the present thesis claims that the contend between the legitimacy of the constitutional jurisdiction and the work field’s limits of its highest organ, is as old as the Republic itself, and that the development of the Supreme Court throughout the XX century could have taken absolutely divergent ways from the ones verified today. For this purpose, this work analyses the multitude of projects for a Tribunal during the Proclamation of the Republic (1889), and in the upcoming years, the discussions about the boundaries of justice’s work field when confronted with undoubtedly political matters, especially in virtue of the relative success reached by the named “Doutrina Brasileira do Habeas Corpus”. With the coexistence of a “political and social time”, marked by the replacement of a monarchy for a republic in a context of tradition and modernity at the turn of the XIX century to the XX century, with a “law moment” that – nonetheless influenced by this change – cannot be measured at the same pace of days, months and years. Hence, it is claimed in here that the Constitution of 1891 – a milestone of the Republic’s institutionalization – must not be taken as the “birth certificate” of the Brazilian constitutional jurisdiction, once the “law moment” includes, in a long-term, transformations that (slowly) were already in course for the Empire, and it also comprises the several discussions driven by the Supreme Federal Court’ operation in the early years of the First Republic |
