Abstract: In 2013, the Dominican Constitutional Court through Resolution TC 168/13 retroactively denied Dominican nationality to anyone born after 1929 that did not have at least one parent of Dominican blood. The court order adopted a restrictive interpretation of the jus solis principle, and caused the denationalization of people who were hitherto recognized as Dominicans. The most affected group corresponded to the Dominicans of Haitian ancestry, many of which became statelessness, no longer having a nationality bond with any State. The resolution shed light on the topic and projected the Dominican Republic as the most notorious statelessness case in Latin America and the Caribbean. However, the court decision was not an isolated case, instead it represented a more comprehensive manifestation of a continuous process of erosion of the nationality right of the population of Haitian descent in the Dominican Republic. This process was intensified in the 1990’s and then International bodies had already taken stances on the matter, including the Inter-American Court of Human Rights, in 2005, in line with the Yean and Bosico decision. While the issue persists without an effective solution for the population of Haitian origin, perplexities emerge. If the right to nationality is enshrined in many international human rights instruments, on the other hand, the States are responsible for establishing which criteria will decide whether a person is a national or not, that is, conforming the national identity and building an ‘imagined community’. For that, the criteria the states adopt to recognize an individual person as member of its community holds deep connection with historical, linguistic, religious, cultural, and racial factors. The history of the Dominican Republic unveils a tumultuous relation with Haiti, which largely influenced the construction of the national identity of the Dominican Republic and cemented an anti-Haitian feeling, also defined by as racist ideologies. In light of this context regarding the Dominican Republic, this work aims to investigate, based on the whole of Dominican- Haitian civil society organizations, what the statelessness situation in the Dominican Republic reveals about the limitations and the opportunities that arise from International Human Rights Law. It is argued that International Law, in a sense has fallen prey to its own dependence on the State apparatus. Thus, the very claim of the right to nationality takes the model of the nation state as a precondition, this way bringing much complexity to the debate and use of the aforementioned right. However, international human rights instruments and bodies have been a key avenue for amplifying and reverberating the demands of organized civil society in the ambiguous and challenging struggle for the right to nationality- the right to belong.
